Gurugram hit-and-run case accused arrested, attempt to murder charge added

Kalyan Bainsla, the car driver accused of hitting a woman sports bike rider on Golf Course Road, was arrested from Rajgarh in Rajasthan on Tuesday, Gurugram Police Commissioner Sibash Kabiraj said.

The arrest came after Gurugram police added a charge of attempt to murder under Section 109 of the Bharatiya Nyaya Sanhita (BNS) in the case. The provision carries imprisonment of up to 10 years.

The case had triggered widespread outrage after a chilling video surfaced showing a speeding car hitting a sports bike ridden by a woman, knocking her off the motorcycle and dragging the two-wheeler for several metres. The occupants of the car allegedly fled the spot following the collision.

The biker, identified as Siya, sustained injuries after falling onto the road and later shared details of the incident on her Instagram profile.

Siya said she was riding her Aprilia RS 457 sports bike with a group of bikers on Golf Course Road on Sunday when a car allegedly began following them. She alleged that the occupants approached her and started misbehaving. When she asked them to maintain their distance, they allegedly asked her to stop the bike.

She also claimed that the occupants appeared to be intoxicated.

According to Siya, the car later overtook the group and struck her bike from the side, causing her to fall onto the road.

The incident was captured by a camera mounted on her bike and the footage was later shared on social media, triggering anger among users and renewed concerns over rash driving and road rage on city roads. Another video, recorded by a rider travelling behind the group, has also gone viral.

The video captured by Instagram user 'youknowabhishek_' shows the car driver first signalling Siya to stop. When she did not stop, the accused allegedly steered the car towards her sports bike and hit it from the side. The Instagram user said that he no longer feels that Gurugram is safe for women.

Siya later released another video on social media in which she levelled serious allegations against Bainsla and questioned why he did not stop at the scene if he was genuinely distressed by what he described as an accident.

She alleged that she was targeted because she is a woman biker and that there was a deliberate attempt to stop her. She said her life could have been lost and that the accused did not even attempt to check whether she was safe after the collision.

Siya said Bainsla did not stop for even a second after hitting her with his car.

"I feel ashamed of such people. Women feel unsafe on the roads of Delhi and Gurugram," she said.

She also said the two videos that have surfaced in connection with the hit-and-run case constituted sufficient evidence. The accident, she said, was fully captured on camera, showing the car hitting her bike and the driver fleeing the scene.

People like him need to be "taught" how to drive, she added.

The car's details were also provided to the police, and the vehicle was reportedly registered in the name of Manish, a senior police officer said.

Taking suo motu cognisance of the matter, Gurugram police had earlier registered a case at the Sector-56 police station. According to ACP (Headquarters) Abhilaksh Joshi, the FIR was registered against the accused driver under Section 281 of the BNS for rash driving and Section 125 for causing hurt.

"We have taken cognizance of the matter based on the video and are investigating," the officer said.

Police had subsequently identified Bainsla and formed three special teams to trace him.

"We have identified the accused, and three special teams have been formed to nab him," Joshi had said.

Bainsla, however, denied deliberately hitting Siya and maintained that the incident was an accident. He said he had "lost control near a U-turn".

"About 20 to 22 motorcyclists sped past me. I didn't realise a young woman was riding one of the bikes; I had simply asked her and the young man accompanying her to slow down. I did not hit them intentionally."

"She was turning without checking her mirrors; just then, near a U-turn, I lost control of the car, and the collision occurred. It was my fault; I admit it," he said.

Bainsla, a gym owner who describes himself as an international kabaddi player, said he fled the spot because he feared the group of bikers would beat him and his family. He subsequently deactivated his Instagram account amid the controversy.

"I was travelling with my family. I didn't make any gestures at the young woman; I simply asked her to ride her bike slowly. I admit that a collision occurred. Had I stopped right then, those people would have beaten us up," he told the media.

Bainsla said he had been travelling with his sister and two cousins at the time of the incident.

Siya, a resident of Delhi, has completed a course in fashion designing and also contested the 2022 municipal elections from Kalkaji. Her father, Roshan Chauhan, is a member of the Aam Aadmi Party.
