fomo.gg respects trademarks and takes proactive steps to ensure that creators using fomo.gg respect the trademark rights of others.
For clarity: a trademark is a word, slogan, symbol, or design used to distinguish one person's or company's products or services from another's. The owner of a trademark has the right to prevent others from using the mark—or any confusingly similar mark—without authorization.
fomo.gg's trademark guidelines are designed to prevent confusion regarding who provides, is affiliated with, or endorses a creator's token, livestream, comments, or any other content. Please note that these guidelines apply only to content accessible via "fomo.gg" or "swap.fomo.gg" URLs. These guidelines do not apply to information stored on a blockchain or to any third-party website that fomo.gg does not control.
To that end, our trademark guidelines are straightforward:
Guidelines
- Do not use trademarks that do not belong to you without explicit permission.
- Do not use someone else's trademark in any manner likely to cause legitimate confusion about ownership or affiliation.
- Always obtain explicit permission before using a trademark or publishing content suggesting that the trademark owner endorses, sponsors, or partners with you or your content.
You may:
- Reference someone else's trademark in passing (e.g., "I love [trademark]").

Create parodies, commentary, or fan content, provided that:
- You make it clear that your content is a parody, commentary, or fan creation, and not affiliated with the trademark.
- You include a disclaimer or caveat in your title to distinguish it — for example, "[trademark] fan," "[trademark] parody," or "[trademark] commentary."
- Have fun, be creative, and engage positively with others — but don't impersonate or mislead people into thinking you are the trademark owner.
fomo.gg does not adjudicate trademark disputes. Any such dispute is strictly between the trademark owner and the creator(s) involved.
Reporting Trademark Infringement
If you believe a creator on fomo.gg is violating your trademark rights, please send an email to fomodotgg@gmail.com including the following details:
- Your contact information: name, physical address, telephone number, and email address. Include a statement confirming that you are either the trademark owner or authorized to act on their behalf.
- Identification of the trademark: a clear description of the mark, including its registration or application number, where it is registered, and the goods or services it covers.
- Identification of the creator: information reasonably sufficient for our team to locate and identify the creator or content (e.g., token name, username, livestream URL).
Where possible and appropriate, fomo.gg will notify the creator of the reported trademark claim.
Response to Trademark Infringement Reports
When fomo.gg receives a report of trademark infringement, we will:
- Review the report to confirm that it is complete and legitimate;
- Evaluate it against these guidelines, our content moderation policy, and other applicable policies;
- If we determine, in our sole discretion, that content on our site violates another party's trademark rights, we will remove or disable access to that content;
- Notify the creator about the action, where possible; and
- Allow the creator to respond by emailing fomodotgg@gmail.com.
Please note:
fomo.gg does not adjudicate trademark disputes. Any resolution must occur directly between the trademark owner and the creator.
If you (the creator) are notified of a trademark claim and believe no violation occurred, please email fomodotgg@gmail.com with:
- Your contact information: name, address, phone, number, and email address.
- Proof of rights: documentation showing permission to use the trademark or evidence that your use qualifies as parody, commentary, or fan-related content.
Repeat Violations
fomo.gg may terminate or restrict a creator's access to the platform if it determines that the creator is a repeat or intentional trademark violator.
Policy Updates
fomo.gg reserves the right to revise or update these Trademark Guidelines at any time. Continued use of our services after any such updates constitutes acceptance of the revised policy.
