Terms of Use

These Terms of Use constitute a legally binding agreement between you ("you" or "your") and Fomo.gg ("Fomo.gg", "Entities or affiliates", "we", "our" or "us"). These Terms govern your use of all Fomo.gg Services made available to you on or through the Fomo.gg Platform or otherwise. Fomo.gg Services may be developed, maintained, and/or provided by Fomo.gg Entities or affiliates.

By accessing the Fomo.gg Platform and/or using the Fomo.gg Services, you agree that you have read, understood, and accepted these Terms, together with any additional documents referenced herein. You acknowledge and agree that you will be bound by and comply with these Terms, as updated from time to time. BY ACCESSING THE FOMO.GG PLATFORM AND USING FOMO.GG SERVICES, YOU IRREVOCABLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR SIMILAR MASS ACTION IN ANY JURISDICTION OR BEFORE ANY TRIBUNAL AS STATED IN SECTION 28. You also expressly agree that any claims against any Fomo.gg-related entity or affiliate will be subject to mandatory, binding arbitration as stated in Section 27.

If you do not understand or accept these Terms in their entirety, you should not use the Fomo.gg Platform.

RISK WARNING

The Fomo.gg Platform and Services generally involve interacting with user-generated Digital Assets in various ways. Neither Fomo.gg Entities nor any affiliates are responsible for user-generated Digital Assets that you may, in your sole discretion, engage with on the Fomo.gg Platform or via Fomo.gg Services. You should fully understand the risks involved before using the Fomo.gg Platform and Services.

The value of User-Generated Digital Assets, including memecoins commonly found on the Fomo.gg Platform, can fluctuate significantly, posing a material risk of economic loss when buying, selling, holding, or investing in any Digital Asset. You should carefully consider whether participating on the Fomo.gg Platform and Services is suitable for you, taking into account your personal, financial, or other circumstances.

Fomo.gg is not your broker, intermediary, agent, or advisor and has no fiduciary relationship with you. We do not provide investment advice. Any communication or information provided on the Fomo.gg Platform or Services should not be construed as financial advice. You are solely responsible for evaluating whether a Digital Asset is appropriate for you and for any losses or liabilities resulting from your decisions.

1. Introduction

1.1. Fomo.gg Entities and their affiliates develop, maintain, operate, and provide access to the Fomo.gg Platform and Services.

1.2. By using the Fomo.gg Platform or Services, you enter into a legally binding agreement with Fomo.gg Entities and affiliates.

1.3. You acknowledge that you must read these Terms carefully and notify us if you do not understand any part.

1.4. You expressly agree to comply with any additional terms or conditions applicable to your use of the Fomo.gg Platform or Services.

2. Eligibility

2.1. To use the Fomo.gg Platform and Services:

  1. You must be an individual, corporation, legal entity, or other organisation with full authority and capacity to:
    1. Access and use the Fomo.gg Platform; and
    2. Enter into and comply with your obligations under these Terms.
  2. If acting on behalf of a legal entity, you must be duly authorized to bind that entity.
  3. You must not be located or operating in jurisdictions where access is illegal or prohibited, including any country on Fomo.gg's List of Prohibited Countries.

2.2. We may amend eligibility criteria at our discretion without prior notice. You are responsible for staying updated on these Terms.

3. Fomo.gg Platform

3.1. Use of the Fomo.gg Platform and Services is at our absolute discretion. We may refuse or restrict access for any reason.

3.2. You must not post abusive, defamatory, misleading, or illegal content on the Platform or in connection with user-generated Digital Assets. Violations may result in restricted or terminated access.

4. Fees and Calculations

4.1. Fees for Fomo.gg Services may apply and will be disclosed prior to usage. Access to the Fomo.gg Platform itself is currently free.

4.2. You are responsible for any third-party fees incurred when using Fomo.gg Services.

4.3. You authorize us to deduct applicable fees from any connected Wallet.

4.4. We may amend fees from time to time. Continued use of Services constitutes acceptance of updated fees.

4.5. Fee calculations by Fomo.gg are final in the absence of a Manifest Error.

5. Records

We maintain personal data for continued Platform use and as required by law. Use and rights related to your data are outlined in our Privacy Notice.

6. Accessing the Platform

6.1. You must have the necessary hardware, software, and internet access.

6.2. Use may be subject to additional rules communicated from time to time.
